1. About these terms
These terms govern the residential building project planning and development services provided by Build By Design (NW) Limited (Company No. 16522245), registered in England and Wales. They apply to enquiries made through buildbydesign.services and to any planning, feasibility or coordination work we agree to carry out for you.
2. Our services
We assist homeowners with the planning and development stages of residential projects. Depending on what you ask us to do, this can include:
- renovation and extension planning, including outline scope and design intent;
- project feasibility reviews and development planning;
- coordination of contractors, surveys and specialist consultants;
- budgeting, cost planning support and programme preparation;
- general project support from initial concept through to the construction stage.
The exact scope of any appointment is confirmed in writing, alongside the deliverables, timescales and any assumptions, before work begins.
3. Quotations and payment
Enquiries and initial feasibility conversations are free of charge. Where you ask us to prepare a proposal or to coordinate a project, we provide a written quotation setting out the agreed scope and fee before any work starts. No payment is taken through this website. Invoices are payable within the period stated on the invoice, and work may be paused where invoices remain outstanding.
4. Refunds
If you cancel an appointment before any work has started, any amount you have paid for that appointment is refunded in full. Once work is under way, any refund is limited to the portion of the fee relating to stages of work that have not yet been performed, less any costs we have already incurred on your behalf, such as third-party reports or surveys we have commissioned. Refunds are made to the original payment method within 14 days of agreement. This does not affect your statutory rights.
5. Cancellation
You may cancel an appointment or an ongoing instruction at any time by contacting us in writing at support@buildbydesign.services or on +44 7585 131401. Cancellations received at least 48 hours before a scheduled appointment, meeting or site visit are rescheduled or refunded in full. Cancellations with less than 48 hours’ notice may be subject to a charge covering the time reserved and any travel or third-party costs already committed, up to the value of the appointment. Where either party ends an ongoing instruction, the stage of work reached is agreed in writing and invoiced or refunded accordingly.
6. Cookies
This website uses essential cookies to operate and to remember your cookie preference, and optional analytics cookies to help us understand how the site is used. Optional cookies are used only where they are permitted in your browser, and you can accept, refuse or change your choice at any time through our cookie notice or your browser settings. 7. Our responsibilities and limitation of liability
We carry out our work with reasonable skill and care and in accordance with the scope agreed in writing. We are responsible for our own services but we are not a contractor, structural engineer or planning authority, and we do not guarantee that a planning application, quotation from a third party or project outcome will be approved, granted or achieved. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be limited.
8. Changes to these terms
We may update these terms from time to time. The version that applies to your appointment is the one published on this website at the time your appointment is confirmed.
9. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
